Check the wiring at the boot hinge, common problem on the e36, look here http://www.bimmerforums.co.uk/forum/...problems-t208/

Good point, the interior lighting works off the central locking module which may be picking up interference from a sidelight feed that runs from body to boot

Would that not affect all the interior lights though

Maybe the headlight was changed at somepoint, and whoever changed it broke the original earth wire, check the wiring from the headlight in case its been cut and spliced on to another earth ..

What do you mean it 'stays on',. Does the drivers side light work OK. Did the footwell lights used to work or has it been like this since you got the car

cheers for the pointers so far!!! well iv only had the car for a week, i brought it during the day and didnt notice it til i took it out one evening any way the passenger side does work, but only when the headlights are on, and then its on all the time!!! the drivers side works fine so does the rest of the lights in the interior. i had a 92 astra before the beema and someone had fitted door poppers made a complete mess of the wireing, so im no stranger to sorting out some one elses bodge ups!!!

It does sound like you have a wiring/earth problem. From what I can see on the wiring diagrams, both footwell lights are wired together so for one one of them to be playing up, there is something not right.
Try switching the interior lights to the 'off' position then see what happens with the footwell lights.
Check that both lights have the correct bulbs fitted. (wrong rated bulbs can cause wierd things).
Otherwise it's a wiring check required

some early e36 didn't have footwell lights my 95 328 and 96 323 dont have them
but they can and do get retrofitted
this is why my 328 has had them fitted by the previous owner but they were wired up on all the time and i do mean all the time! even when parked and locked up alam on! (there are LED bulbs so should be ok)

I suspect your car could have been wired up to only come on with the lights
    - pull the panel off and have a look at the wiring and see if its original etc
