can someone advice me how i find out if the design e46 3 series of the uk version differs from the us model ?
I was informed today by my mechanic that my car’s rear suspension differential housing mounting has pulled through the boot floor .I was advised to contact Bmw which I did .With the helpful assistance of Sharon at Bmw Bowker Preston . I arranged to be towed in to Bowker for inspection as the car was dangerous to drive .
I have researched the fault and was appalled to discover that the fault was a due to the constant loading and unloading associated with normal driving can weaken the sub-frame to the point where it cracks and separates from the chassis, resulting in damage to the vehicle.
A class action was made in America and settled all that 1999-2006 BMW 3 Series vehicles suffer from defective sub-frames. As part of the settlement, BMW has also agreed to implement a National Sub-Frame Inspection and Repair Program. All current owners and lessees of a 1999-2006 BMW 3 series vehicle were notified of the sub-frame problem and to present their vehicle for a free inspection and repair (if needed).

I have spoken to bmw as my car is 11 years old they are washing their hands off me .they state that the design is different than US ...IF SO WHY HAS MY CAR AND MANY OTHERS IN THE UK HAD THE SAME FAULT ?

I don't believe the design was different at all, it's more the fact that BMW UK can get away with it in this country.

i thought the same as my mechanic has seen a few do the same
i am preparing to go through small claims court because if i was informed and offered an inspection the same time as america it would have been within the 10 year period .
    but
I am absolutely astonished that I have been driving a car that I loved and was going to upgrade with my children in .I am sure many other 3 series drivers would like to be informed of this potentially lethal fault . as it covers all model 1999-2006 !

If you are considering legal action, then maybe you should have a read of this: E46 Rear Subframe Action Group UK

And it doesn't look too good, i'm afraid.

This is a real worry for me, as i have the big ol' 3l diesel, remapped to silly torque figures.

Every time I go to put that foot down, I think "Nice and gentle, don't rip the subframe" lol.

keep us posted on how this turns out! ... and GOOD LUCK!

I feel for you, However all is not lost, It is repairable, i really hope that you are able to get the job done for free, as at the end of the day it is a design fault. However worst case senario you are able to buy the complete rear floor section that is faulty and replace it's just a bit of a night mare job, i completed this repair on a 1992 E36 they suffred with a similar problem, just insure you add the strengther kit to stop this from happening in the furture. I wish you good luck and will be following this thread. Just so you know it looks like my E46 had the same issue and it was repaired, reason being it looks like the rear section off the boot and under rear seats has been replaced, i will have a dig around though the recpeits and what have you and see if i can find out who replaced it and if it was payed for the costs behind it.

    Cheers
    Deklan

I wish i had been informed of this fault by bmw at the same time as the US then it would have been in the 10 year timeframe .
