My used 1 series came with a BMW Approved Used Car Warranty which states "All service work must be carried out by an Authorised Dealer or BMW Service Authorised Workshop" but my understanding from trawling the internet is that EU anti-competition laws (EU Treaty Article 81) says they cannot do this and any garage can do the work. How do BMW get away with this? What's the catch? Has anyone ever had to make a warranty claim after using a non-franchise garage for servicing?

It's also because it's a third party warranty arranged by BMW through Mondial. If you take it out of the dealer network they won't honour the warranty.

As a follow up on this thread, I e-mailed BMW regarding servicing affecting the used car warranty and received the following reply:

Under Block Exemption, drivers are able to have routine servicing carried out any any garage of their choice, without invalidating the warranty. However, if non approved parts are used or a fault occurs which is directly attributed to the work carried out, the warranty will not cover the cost of repair. Any warranty work must be carried out by an approved dealership.

Sounds ok in theory won't work in practice as servicing outside of the BMW network and they can't guarantee genuine parts were used so will not honour the warranty.

Fair point! My local independent BMW garage are happy to state on the invoice that only genuine BMW parts have been used. Plus I would hope that BMW could recognise their own parts from copies or cheaper brands.

I have booked my service with the indy garage - as you say, it could all end in tears but I for one am going to risk it to save £260 on a service! I will report back if I ever have the misfortune of having to have a warranty repair.

Thanks to everyone for their contribution

If the warranty cost. say £100 per month you can save this and ifnothing goes wrong you still have the money. I have just had a £560 gearbox (brains) repair bill and is still much cheaper than taking out a warranty.
