get some quotes from some reputable garages to compare the costs and then offer to pay that...hoping its cheaper of course!

Unfortunately it will be their word against yours in court and the mere fact you let them pick the car up does tend to swing in their favour. I.e. they pick the car up, offer a quote, you think the quote is too expensive so then what??...they then drop the car back to you? Im not saying you agreed to them doing the work before hand...I'm just saying what I think it tends to appear like. Hope it turns out ok in the end.

I take it you have not got your car back?

As already mentioned get some quotes for the work from other garages to see how reasonable the work is.

I would suggest getting this closed quickly mate - a car in their "care" wont be looked after much in that its not exactly there for could cause.

I hate to say it, but you also want to weigh up what the car is worth to you.

Did the police themselves tell you they'd arrest you if you took your car?

I remember a builder mate of mine, he built a garage for a customer who then refused to pay him a penny. In the end my mate demolished the garage he built and got into serious trouble for doing so - even though he could have argued, the customer hadn't paid so the garage materials belonged to him. Didn't pan out that way.

Personally I'd take the car anyway, and if the police arrested me I'd tell them I'm the legal owner, and the 'debt' can be settled by the garage via the courts. Just because you own someone money, I don't think that means they can take legal possession of your legal possession. Its not like they're debt collectors with a warrant from a court issuing reposession etc.

I could be wrong, and maybe its just me, but I'd love my day in court getting charged with stealing the car *I* own

Alternatively, pay someone to steal it if its parked outside, have them torch it and write it off - then put in a claim on the garages insurance

Yeah, oldish guy, seems pleasant enough and actually quite helpfull, I would have thought you could come to an arrangement if you turn up on his doorstep.
Hows about been nice as pie with him and ask to take car fo a pre payment test drive with the bloke in tow and just keep driving all the way home, Bung him few hundred and tell him to do one, That'd be my plan. In Fact if you want i'll do it for ya then you cant get 'arrested', i can bring the car to mine and you can collect.

While I cant fault the ideas and intention behind it, please remember that everything on the internet is effectively recorded and as such if the original poster does take action of whatever sort, that the powers that be might have all the information they need right from the mighty google!!

    Its happened before....

Also, to all posters particularly the original thread starter. I totally empathise with your situation and it sounds genuine, however naming and shaming companies has lead to legal threats by the company owners to Bimmerforums. Also, if they really want to be real asshats they can sue for defamation and if they have the money. It could be very expensive for all concerned.

To that end I have removed the garage name, and it is now listed as a transmission garage in huddersfield.

If anyone wants exact details please pm the OP. If the garage is named again I will have no option but to delete the thread.

    thanks

If this goes to court it will hinge on whether you instructed the garage to quote on the repair or to do the repair, someones word against another's.

The problem you have is that you instructed the garage to come and pick your car up which kind of suggests you wanted them to repair it, if you didn't why didn't you just call them and ask for a price to supply and fit a box for your car?

Not coming down on anyones side here just putting how it would look from the "outside".

I would have thought that the garage would have called for the go ahead on a repair of this cost, however if they are an auto box specialist then they are probably seeing 4 and 5k bills all the time and your repair didn't seem that expensive to them.

You say you could get a second hand box cheap but that aint what a specialist is about and if thats the route you wanted to go down why put it into them.

What exactly was done for this price?

Wow, sorry to hear that bro!!

Can't you ask them to remove the parts you didn't ask for? I'm sure a friend of a friend said something similar had happened to him and he had forced the garage to remove the parts he hadn't asked for and put the old ones back!

The first place I took Immo to, I gave them a list of perhaps 8 items I wanted doing - left the car with them, got back and they had done 3 of the things and just not bothered with the rest, the bill did reflect that though and was way lower than expected.

The next place was really honest, made me feel really comfortable, really knew what they were doing. But due to a a parts issue (caused by the guy i bought the parts from) their quote turned from £300 into a bill of £707!

But i really didn't mind because they kept me updated on almost an hourly basis, and while they didn't explain that "it's going to cost X amount more" they did keep me posted on the time and parts it was taking and I knew their hourly rate, so it wasn't too much of a shock.

I MUCH MUCH MUCH porefer the latter. I'd rather be kept updated, have the stuff i ask for done and if there are problems that will increase my bill all i want is to be informed.
