    Hi i have just bought a 2000 bmw 316i compact last week from a home car dealer.I drove the car home and noticed the car was snaking a little and didnt seem rite to drive.I took it to a garage on friday thinking it was wheel alignment and i was told that it cannot be tracked on the back wheels and that something was seriously wrong with the rear of the car each rear wheel was towing out 12 degrees on eithier side.The person in the garage conntacted a specialist in rear wheel drive cars and i was told that it is a death trap and shoudent be on the road but the car had some how just passed a 12 month mot a week before i bought it.I tried to contact the dealer but he is currently on holiday all i want is my money back as he sold me a car that shoudent be on the road and is a danger to the driver and other people.

    Simon, have you got anything in writing from the original seller and the garage who found the major problem? I would definately try and get a report on the dangerous state of the car and take it to the seller on his return, even if he says no warranty he's still liable for selling goods not suitable for the purpose.

    Have you had a BMW specialist inspect it? they should be able to pick out the actual culprit, like if it has been in a accident, or the subframe mounting points are torn.

    As for the MOT, UNLESS there is anything VISIBLY wrong then it would pass a MOT because the wheel alignment isn't checked on a MOT and the tester wouldn't have driven your car any distance at speed.

    A couple of questions if i may......

    Did you drive the car before handing over the money?
    Are you aware of any work being done on the car between seeing it and picking it up?
    If you have the four wheel alignment sheet i'd be intrigued to see it as what you are saying is a hell of a lot in terms of geometry settings.

    As said above, the MoT involves a shake of the wheels to check steering suspension components and does not involve a geometry check.....has the car got new tyres on the back by any chance??

    This is not the first time I've heard of a car passing an MOT only to be found dangerous.

    The same thing happened to me a while back. The car had gone through MOT, and then barely 3 weeks later, I had to replace the rear tyres, as one had perished all around the inner circumference. This was quite obvious.

    Another instance was on the day collection, I found the drivers' side washer nozzle was faulty, and one headlight wasn't working. I 'phoned the MOT station concerned, and all they could say was 'this must have happened after the MOT'.

    What rubbish!

    I've begun to wonder how much money is exchanged between dealer and MOT station to secure a pass in some cases...

    Incidentally - both the above cars were E46's, and both needed rear brake pipe replacement, which no doubt is an expensive job.

    Several years ago, a mate bought a MK II Golf for his missus, and within day she found a hole in the floor. He contacted the MOT station concerned, who then offered him money to get it fixed... Nice.
    Now driving a 2000 523i auto (with 190k miles!) and a Skoda Octavia 1.8T estate.

    I've had several cars since my last updates here - so won't bother posting pics.

    4hrs at my local garage as the fuel tank requires removal!!!! This is becoming more and more common on older E46's now
